Option Move To Library Trash not visible

Observed behavior

in certain cases, the option Move To Library Trash is not available

Expected behavior

Move To Library Trash to always be available when I am selecting files, except when I am selecting files that are in the trash

Steps required to reproduce

  1. open photo stream
  2. select one collection
  3. make a search that contains the not in expression (ref)
    (the search that I am doing is in <event name> not in <collection name>
  4. right click on a file

Move To Library Trash does not appear, I only see delete permanently
